Summary

These Terms cover your use of Capone’s Bones: your account, the game, dough, purchases and how you treat other players. Capone’s Bones is operated by Sorce Code Labs, LLC, a Utah limited liability company (“we”, “us”, “our”). By using the app you agree to these Terms and to our Privacy Policy.

Agreement

By downloading, installing or using Capone’s Bones (the “App”) you agree to be bound by these Terms of Service (the “Terms”). If you do not agree, do not use the App.

The service

Capone’s Bones is a dice game for mobile devices. It includes:

  • Single-player modes, live online play, private online games with friends, and Private Heist, local play between nearby devices over Bluetooth.
  • Leaderboards, awards, a friends list (Crew) and other social features.
  • An in-game currency, dough, and optional in-app purchases.

You can play the first three campaign jobs and Practice without an account. An account is needed for everything else, including online play, the Daily Heist, rewards and purchases. Private Heist needs the Premium Bundle.

Beta builds

We may offer pre-release versions through Apple TestFlight, Google Play testing or similar programs. These Terms and our Privacy Policy apply to them. A beta may differ from the store version (for example, it may show test ads or have features switched on or off), and features, balance and availability in a beta may change or not ship. We may end or change beta access at any time. We may use feedback you give us to improve the App with no obligation to you.

Eligibility

  • You must follow the laws that apply to you when using the App.
  • You must be at least 13 years old to create an account.
  • If you are under the age of majority where you live, you need permission from a parent or legal guardian to use the App.

Your account

  • You can create an account with email, Sign in with Apple or Google Sign-In.
  • You are responsible for keeping your sign-in details private and for everything done with your account.
  • Tell us straight away if you think someone else is using your account.
  • We may suspend or close accounts that break these Terms.

Purchases

Purchases are processed only by Apple or Google through their stores. Today the App sells consumable items (such as dough) and one-time unlocks (such as Remove Ads and the Premium Bundle). It does not sell subscriptions; if it ever does, billing, renewal and cancellation will follow the store’s subscription rules and your store account settings.

Dough

  • Dough is the App’s in-game currency. You can earn it by playing or buy it with real money.
  • Dough has no real-world value. It cannot be exchanged for cash, sold, or redeemed for anything outside the App.
  • The App does not offer gambling. Dough and in-game rewards are for entertainment only and are not real-money gaming.
  • All purchases are final and non-refundable, except where the law requires otherwise.
  • We may adjust, rebalance or retire virtual items, progression and unlocks as the App changes.

Unlocks

  • Unlocks such as Remove Ads and the Premium Bundle are tied to your account and to the store account you bought them with.
  • We may change or discontinue premium features.

Refunds

Refunds follow Apple’s or Google’s policies, and only they can grant one. We do not process refunds directly. Ask Apple or Google; the support page has the links.

Fair play

To keep the game fair, you agree not to:

  • Exploit bugs, matchmaking or rankings.
  • Use bots, scripts, macros or other automation.
  • Harass, impersonate or abuse other players.
  • Manipulate purchases, ads, rewards or progression, including referral rewards.
  • Get around platform, account or device restrictions.

Conduct

You agree not to:

  • Use the App for anything illegal.
  • Hack, cheat or exploit the App.
  • Interfere with other players’ use of the App.
  • Share your account with others.
  • Access the App with automated systems.
  • Reverse engineer or decompile the App.
  • Post offensive, abusive or inappropriate content, including display names and profile photos.

Intellectual property

Ours

  • We own the App and everything in it, including its content, features, artwork, trademarks and logos.
  • You may not copy, modify or distribute any part of the App without our permission.

Yours

  • You keep ownership of content you create, such as your profile photo and display name.
  • You give us a licence to use that content to provide the App, including showing it to other players.
  • You confirm you have the right to give us that licence.

Disclaimers

Availability

  • We do not guarantee that the App will be uninterrupted or error-free.
  • We may change, suspend or discontinue features at any time.
  • We are not liable for losses caused by service interruptions.

Game outcomes

  • Dice rolls are decided by random number generation.
  • We do not guarantee any result, and past results do not predict future ones.

Other services

  • Apple, Google, sign-in providers, analytics providers and ad providers run their own services under their own terms and policies.
  • We are not responsible for outages or policy changes in services we do not control.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL OR CONSEQUENTIAL DAMAGES.
  • OUR TOTAL LIABILITY IS LIMITED TO THE AMOUNT YOU PAID FOR THE APP IN THE PAST 12 MONTHS.
  • SOME JURISDICTIONS DO NOT ALLOW THESE LIMITATIONS, SO THEY MAY NOT APPLY TO YOU.

Indemnification

You agree to indemnify and hold us harmless from any claims, damages or expenses arising from your use of the App, your breach of these Terms, or your violation of anyone else’s rights.

Termination

By you. You can stop using the App at any time, and you can delete your account in the App (menu, Preferences, Delete Account).

By us. We may suspend or end your access if you break these Terms, if you engage in fraud or illegal activity, or if we discontinue the App. We may also remove or limit specific features, purchases or rewards where needed to protect the game’s integrity, security or other players.

Changes to these Terms

We may change these Terms. We will tell you about significant changes by updating the date at the top of this page, by a notice in the App where practical, and by email for major changes. If you keep using the App after a change, you accept the new Terms.

Disputes

Governing law

These Terms are governed by the laws of the State of Utah, United States, without regard to conflict of law principles. The courts of Utah are the venue for any dispute not resolved as described below.

Process

  1. Contact us first so we can try to resolve it.
  2. If it is not resolved, it may be settled by binding arbitration.
  3. Class action waivers may apply where the law allows.

Severability

If any part of these Terms is found unenforceable, the rest stays in effect.

Entire agreement

These Terms and our Privacy Policy are the entire agreement between you and us about the App.

Apple App Store

If you downloaded the App from the Apple App Store:

  • These Terms are between you and us, not Apple.
  • Apple is not responsible for the App or its content.
  • Apple has no obligation to provide support for the App.
  • If the App fails to conform to any applicable warranty, you may notify Apple for a refund of the purchase price, if any.
  • Your use of the App must also comply with Apple’s terms, including the Apple Media Services Terms and the Licensed Application End User License Agreement where Apple applies them. See Apple’s terms for apps from the App Store.

Google Play

If you downloaded the App from Google Play:

  • These Terms are between you and us, not Google.
  • Google is not responsible for the App or its content.
  • Google has no obligation to provide support for the App.
  • Your use of Google Play is also subject to the Google Play Terms of Service and related policies.
